Public holidays 2024 - Special case of May 9
Public holidays 2024 in Luxembourg
Since the entry into force of the law of April 25, 2019, in Luxembourg each employee falling under the Labor Code or the General Statute of State Civil Servants is entitled to 11 legal public holidays per calendar year.
In 2024, two of the eleven public holidays, namely Ascension Day and Europe Day, fall on May 9, although such a scenario was not expressly regulated by the legal provisions.
In order to regulate this type of situation which was not previously provided for by law, the Bill No. 8266 has been prepared and should be adopted soon.
The bill provides for 3 scenarios in which the employee does not work on the day on which two legal holidays fall :
1. Two legal public holidays fall on a working day on which the employee would have worked :
The employee has a right to remuneration for the number of hours of work which would normally have been worked during that day at the normal hourly rate, plus a day of compensatory leave for the 2nd legal public holiday which must be granted within 3 months following the day after the public holiday in question.
2. Two legal public holidays fall on a working day on which the employee would not have worked anyway:
The salary is entitled to one day of compensatory leave which must be granted within 3 months following the day after the public holiday in question, plus one day of compensatory leave for the 2nd legal holiday which must be granted within 3 months following the day after the public holiday in question.
3. Two legal holidays fall on a working day during which the salary would have worked only 4 hours or less:
The employee is entitled to remuneration for the number of hours of work which would normally have been worked during that day, plus a half-day of compensatory leave which must be granted within a period of 3 months following the day after the public holiday in question; as well as half a day of compensatory leave for the 2nd legal public holiday which must be granted within 3 months following the day after the public holiday in question.
